This Copyright & Digital Millennium Copyright Act (“DMCA”) Policy applies to The Culture Radio website, mobile applications, streaming services, podcasts, radio stations, creator platforms, digital media services, and other websites, applications, products, and services operated under The Culture Radio (collectively, the “Platform”).
The Culture Radio operates as part of The Culture Media, under the Society Capital Group family of companies.
This Policy explains the ownership and permitted use of content appearing on the Platform, how copyright owners may report alleged infringement, and how users may respond to copyright removal notices.
1. Copyright Ownership
Unless otherwise stated, the content made available through The Culture Radio is owned by, licensed to, provided to, or otherwise lawfully used by The Culture Radio, The Culture Media, Society Capital Group, their affiliates, licensors, content partners, creators, or other respective rights holders.
Protected content may include, but is not limited to:
- Website design and layout
- Logos and branding
- Graphics and artwork
- Photographs and images
- Videos
- Audio recordings
- Radio programming
- Podcasts
- Interviews
- Articles and written content
- Show descriptions
- Station descriptions
- Original music and recordings
- Promotional materials
- Software and source code
- Databases and compilations
- Digital downloads
- Original social media content
- Advertisements and marketing materials
- Other creative works appearing on or through the Platform
Nothing contained on the Platform should be interpreted as transferring ownership of any copyright, trademark, intellectual property right, or other proprietary right to a user.
2. Third-Party Content
The Culture Radio may display, stream, embed, link to, distribute, promote, or otherwise provide access to content owned or controlled by third parties.
This may include content from:
- Artists
- Record labels
- Music publishers
- DJs
- Podcast creators
- Podcast networks
- Content creators
- Radio programmers
- News organizations
- Syndication providers
- Advertisers
- Sponsors
- Streaming platforms
- Social media platforms
- Distribution partners
- Independent contributors
Ownership of third-party content remains with the applicable copyright owner.
The appearance of third-party content on the Platform does not mean that The Culture Radio or The Culture Media claims ownership of that content.
Third-party trademarks, logos, photographs, artwork, music, videos, podcast materials, and other intellectual property remain the property of their respective owners.
3. Music and Audio Content
The Culture Radio operates digital radio stations and may provide music, DJ mixes, syndicated programming, podcasts, interviews, talk programming, and other audio content.
Copyrights associated with musical compositions and sound recordings may be owned or administered by artists, songwriters, publishers, record labels, performing rights organizations, licensing organizations, distributors, or other rights holders.
The Culture Radio does not claim ownership of third-party musical works or sound recordings merely because they are played, referenced, promoted, displayed, or otherwise made available through the Platform.
Where required, The Culture Radio intends to obtain, maintain, or rely upon applicable licenses, permissions, agreements, statutory licenses, distribution arrangements, or other legal authorization for the use of protected content.
4. Podcasts and Creator Content
The Culture Radio may host, import, index, display, distribute, embed, link to, or provide access to podcasts and other creator content.
Podcast titles, artwork, descriptions, audio, video, trademarks, and other materials may remain the property of the applicable podcast owner, publisher, network, creator, or other rights holder.
The inclusion of a podcast or creator on The Culture Radio does not automatically mean that The Culture Radio owns or controls that podcast or its underlying intellectual property.
Where content is obtained through publicly available RSS feeds, authorized feeds, APIs, distribution services, syndication systems, submissions, partnerships, or other sources, the underlying creator or rights holder retains any ownership rights they otherwise possess.
Creators who believe their content has been included on the Platform improperly may contact us using the information provided below.
5. User and Creator Submissions
Users, artists, DJs, podcasters, content creators, producers, and other contributors may have opportunities to submit content to The Culture Radio.
By submitting content, you represent and warrant that:
- You own the content or have sufficient rights and authorization to submit it;
- Your submission does not knowingly infringe the copyright, trademark, privacy, publicity, contractual, or other rights of another person or organization;
- You have obtained any permissions, releases, licenses, or clearances necessary for the submitted material; and
- You have the authority to grant The Culture Radio any rights required to host, display, distribute, stream, promote, or otherwise use the submitted content as permitted by the applicable submission terms or agreement.
Submitting content to The Culture Radio does not automatically transfer ownership of that content unless a separate written agreement specifically provides otherwise.
Additional terms may apply to music submissions, podcast submissions, creator profiles, radio programming, contests, promotions, and other participation in the Platform.
6. Permitted Use of Our Content
Unless otherwise expressly authorized in writing, content owned by The Culture Radio, The Culture Media, Society Capital Group, or their affiliates is provided for personal and noncommercial use.
You may not, without appropriate authorization:
- Copy or reproduce protected content;
- Republish protected content;
- Sell or commercially exploit protected content;
- Modify or create unauthorized derivative works;
- Redistribute audio, video, articles, images, or other materials;
- Download content where downloading has not been expressly permitted;
- Remove copyright, trademark, attribution, or proprietary notices;
- Use our logos or branding in a manner suggesting an unauthorized affiliation or endorsement;
- Scrape or systematically extract protected content for unauthorized commercial use;
- Rebroadcast or retransmit streams without authorization; or
- Use protected content in violation of applicable copyright or intellectual property laws.
Nothing in this Policy is intended to restrict uses that are permitted by applicable law, including uses that may qualify as fair use under U.S. copyright law.
7. Copyright Infringement
The Culture Radio and The Culture Media respect the intellectual property rights of artists, musicians, photographers, writers, podcasters, producers, creators, publishers, labels, networks, businesses, and other copyright owners.
If you believe material available through the Platform infringes a copyright that you own or are authorized to enforce, you may submit a copyright infringement notification pursuant to the Digital Millennium Copyright Act.
8. DMCA Takedown Notice
A copyright owner or authorized representative requesting removal of allegedly infringing material should provide a written notice containing substantially the information required by 17 U.S.C. § 512(c)(3), including:
- Identification of the copyrighted work claimed to have been infringed or, if multiple copyrighted works are covered by a single notification, a representative list of those works;
- Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient to allow us to locate the material;
- The specific URL or other location of the allegedly infringing material whenever available;
- Your full name and, where applicable, the name of the copyright owner you represent;
- Your mailing address;
- Your telephone number;
- Your email address;
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- A statement that the information contained in the notification is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner; and
- Your physical or electronic signature.
Incomplete notices may delay our ability to investigate or respond to a complaint.

10. Review and Removal of Content
After receiving a valid copyright complaint, The Culture Radio may investigate the matter and take any action it considers appropriate or legally required.
Such actions may include:
- Removing content;
- Disabling access to content;
- Temporarily restricting content;
- Contacting the user or creator responsible for the content;
- Requesting additional information;
- Forwarding the complaint to the affected user or content provider;
- Restoring material following a valid counter-notification where permitted by law; or
- Taking action against repeat infringers.
The submission of a copyright complaint does not guarantee that material will automatically be removed. We may evaluate notices for compliance with applicable law before taking action.
11. Counter-Notification
If content you submitted was removed or disabled because of a DMCA notification and you believe the removal resulted from mistake or misidentification, you may be entitled to submit a counter-notification pursuant to 17 U.S.C. § 512(g).
A counter-notification generally must include:
- Your physical or electronic signature;
- Identification of the material that was removed or disabled;
- The location where the material appeared before it was removed or disabled;
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification;
- Your name, address, and telephone number;
- A statement consenting to the jurisdiction of the appropriate United States Federal District Court as provided under the DMCA; and
- A statement that you will accept service of process from the person who submitted the original infringement notification or that person’s agent.

We may provide a copy of a counter-notification to the party that submitted the original copyright complaint as permitted or required by law.
12. Restoration of Removed Material
Following receipt of a valid counter-notification, material may be restored in accordance with the procedures and time periods established by the DMCA unless the original complaining party informs us that it has filed an action seeking a court order against the person who submitted the material.
Nothing in this Policy requires The Culture Radio to restore content when another lawful basis exists for removing or restricting that content, including violations of our Terms of Use, Community Guidelines, content agreements, creator agreements, or other applicable policies.
13. Repeat Infringer Policy
Where appropriate and in accordance with applicable law, The Culture Radio may restrict, suspend, or terminate accounts or access for users who repeatedly infringe copyrights or other intellectual property rights.
We may also restrict participation by creators, podcasters, DJs, programmers, contributors, or other users who repeatedly submit unauthorized copyrighted material.
The Culture Radio reserves the right to take action against serious infringement even if the individual or organization has not previously received a copyright complaint.
14. False or Misleading Copyright Claims
Copyright notices and counter-notifications are legal communications.
Under applicable law, a person who knowingly makes material misrepresentations concerning whether content is infringing or whether material was removed or disabled by mistake or misidentification may be subject to liability.
Do not submit a DMCA notice solely because you disagree with, dislike, or object to content.
Copyright complaints should only be submitted when there is a legitimate copyright concern.
15. Trademark and Other Intellectual Property Complaints
The DMCA process primarily applies to copyright claims.

16. Embedded and Linked Content
The Platform may contain embedded media or links to content hosted by third-party platforms.
When content is hosted by another provider, The Culture Radio may not have direct control over the underlying file or material.
Where appropriate, copyright owners may also need to contact the service that actually hosts the allegedly infringing material.
17. No Waiver of Rights
Nothing contained in this Policy constitutes a waiver of any copyright, trademark, licensing right, contractual right, defense, limitation of liability, safe-harbor protection, or other legal right available to The Culture Radio, The Culture Media, Society Capital Group, their affiliates, licensors, partners, creators, or content providers.
18. Changes to This Policy
We may update this Copyright & DMCA Policy periodically to reflect changes to our Platform, business operations, legal requirements, licensing arrangements, or copyright procedures.
When material changes are made, the “Last Updated” date at the top of this Policy may be revised.
Continued use of the Platform following an update is subject to the then-current version of this Policy.
