Welcome to The Culture Radio Network.
These Terms of Use (“Terms”) govern your access to and use of The Culture Radio Network websites, mobile applications, radio streams, podcast services, creator profiles, directories, digital content, interactive features, subscription services, and other online products and services made available by The Culture Media, LLC. (collectively, the “Services”).
Please read these Terms carefully.
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional terms or policies applicable to particular Services.
If you do not agree to these Terms, do not access or use the Services.
1. COMPANY AND BRAND STRUCTURE
Society Capital, Inc. is the umbrella company for a portfolio of affiliated companies, businesses, and brands.
The Culture Media, LLC. is the media parent company within the Society Capital corporate family.
The Culture Radio Network, also referred to as “The Culture Radio,” “the Network,” or “the Platform,” is a media, radio, podcast, streaming, digital content, and creator platform operated by The Culture Media, LLC.
For purposes of these Terms, “The Culture Media,” “we,” “us,” and “our” refer to The Culture Media, LLC. and, where applicable, its affiliates, contractors, service providers, licensors, successors, and authorized representatives.
Unless expressly stated otherwise, The Culture Radio Network is a brand and service of The Culture Media, LLC. and is not a separate contracting entity.
2. SCOPE OF THESE TERMS
These Terms apply to your use of The Culture Radio Network Services, including:
- Websites;
- Mobile applications;
- Radio streaming;
- Podcasts;
- Audio programming;
- Video content;
- News and editorial content;
- Creator profiles;
- Creator directories;
- User accounts;
- Music submissions;
- Interactive features;
- Comments and ratings;
- Advertising and sponsorship features;
- Subscription services;
- Premium services;
- Contests and promotions;
- Events;
- Notifications;
- Digital content;
- Software; and
- Other Services that reference these Terms.
Certain Services may be subject to additional terms, rules, guidelines, or agreements (“Additional Terms”).
If Additional Terms conflict with these Terms concerning a specific Service, the Additional Terms will control with respect to that Service.
3. ELIGIBILITY
You must be at least 13 years old to use the Services.
If you are under the age of majority in your jurisdiction, you may use the Services only with the permission and supervision of a parent or legal guardian.
By using the Services, you represent that:
- You meet the applicable age requirements;
- You have the legal capacity to accept these Terms;
- Information you provide is accurate;
- You are legally permitted to use the Services; and
- You will comply with these Terms and applicable law.
Certain content, contests, promotions, events, purchases, or Services may have higher age requirements.
4. PERSONAL AND PERMITTED USE
Unless otherwise expressly authorized, the Services are provided for personal, lawful use.
You may not commercially exploit, reproduce, distribute, sell, sublicense, scrape, republish, or otherwise use our Services or proprietary content except as expressly permitted by us in writing or permitted by applicable law.
Nothing in these Terms prevents creators, advertisers, sponsors, business partners, or other parties from using portions of the Services for authorized commercial purposes under separate agreements with The Culture Media.
5. MOBILE DEVICES AND APPLICATIONS
Certain Services may be accessed through smartphones, tablets, smart devices, connected vehicles, or other mobile devices.
You are responsible for:
- Obtaining compatible equipment;
- Maintaining internet or wireless service;
- Maintaining appropriate software;
- Installing required updates;
- Paying applicable mobile-data charges;
- Paying text-messaging charges where applicable; and
- Complying with your wireless carrier’s terms.
Your carrier may charge you for data, text messages, or other services.
We are not responsible for charges imposed by your carrier or internet provider.
Certain features may not be available on all devices, operating systems, networks, or geographic locations.
6. CHANGES TO THESE TERMS
We may revise these Terms periodically.
When material changes are made, we may provide notice through:
- Our website;
- Our mobile application;
- Email;
- Account notifications; or
- Another reasonable method.
The “Last Updated” date will identify when these Terms were most recently revised.
Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
If you do not agree with revised Terms, you should stop using the Services.
7. PRIVACY
Your privacy is important to us.
Our collection, use, disclosure, retention, and protection of personal information are described in The Culture Radio Network Privacy Policy.
The Privacy Policy is incorporated into these Terms by reference.
By using the Services, you acknowledge the privacy practices described in our Privacy Policy.
8. ACCOUNTS
Certain Services may require you to create an account.
When creating an account, you agree to provide accurate, current, and complete information.
You are responsible for maintaining the accuracy of your account information.
You may not:
- Create an account using false information;
- Impersonate another person;
- Create an account on behalf of another person without authorization;
- Use another person’s account without authorization;
- Sell or transfer an account without permission; or
- Create accounts to circumvent a suspension or termination.
We may refuse registration, suspend accounts, or terminate accounts where permitted by these Terms and applicable law.
9. ACCOUNT SECURITY AND PASSWORDS
You are responsible for maintaining the confidentiality of your password and account credentials.
You are responsible for activity conducted through your account except to the extent otherwise required by applicable law.
You agree to notify us promptly if you discover or reasonably suspect:
- Unauthorized account access;
- Unauthorized password use;
- Account compromise;
- Fraudulent activity; or
- Another security issue involving your account.
We may require you to change your password or take other security measures when reasonably necessary.
10. USER CODE OF CONDUCT
You agree to use the Services responsibly and lawfully.
You may not use the Services to:
- Violate applicable law;
- Commit or facilitate fraud;
- Infringe copyright, trademark, privacy, publicity, or other rights;
- Impersonate another person or organization;
- Misrepresent an affiliation, endorsement, or sponsorship;
- Harass, threaten, stalk, or unlawfully target another person;
- Distribute unlawful threats;
- Upload viruses, malware, malicious code, or harmful software;
- Attempt unauthorized access to our systems;
- Circumvent security measures;
- Interfere with the operation of the Services;
- Conduct unauthorized scraping or data harvesting;
- Collect personal information about others without authorization;
- Send unauthorized spam or mass solicitations;
- Manipulate ratings, votes, streams, plays, downloads, impressions, or other metrics;
- Use automated systems to artificially increase engagement;
- Attempt to reverse engineer protected software except where permitted by law;
- Use another person’s account without permission; or
- Encourage another person to engage in prohibited conduct.
We may investigate suspected violations and take appropriate action.
11. USER CONTENT
The Services may allow users to submit or publish content (“User Content”).
User Content may include:
- Comments;
- Reviews;
- Ratings;
- Photographs;
- Videos;
- Audio;
- Podcasts;
- Music;
- DJ mixes;
- Creator profiles;
- Biographies;
- Artwork;
- Messages;
- Show information;
- Music submissions; and
- Other materials.
You are responsible for User Content you provide.
You represent that you possess all rights, permissions, licenses, and authorizations necessary to submit your User Content.
12. OWNERSHIP OF USER CONTENT
You retain ownership of original User Content that you create.
Submitting User Content does not automatically transfer ownership of your copyrights to The Culture Media.
However, you grant us permission to use User Content as reasonably necessary to operate and promote the Services.
13. LICENSE FOR USER CONTENT
By submitting User Content through the Services, you grant The Culture Media a nonexclusive, worldwide, royalty-free, sublicensable, and transferable license to:
- Host;
- Store;
- Reproduce;
- Display;
- Stream;
- Transmit;
- Distribute;
- Publicly perform;
- Format;
- Encode;
- Resize;
- Promote; and
- Otherwise use the User Content
as reasonably necessary to provide, operate, distribute, market, and promote the Services and your participation in them.
This license does not transfer ownership of your underlying User Content to us.
Where content is removed, certain copies may remain temporarily in backups or previously distributed materials.
14. PUBLIC CONTENT
Certain portions of the Services are public.
Information you publish publicly may be viewed, copied, indexed, shared, or redistributed by others.
Public information may include:
- Creator profiles;
- Usernames;
- Profile photographs;
- Comments;
- Reviews;
- Ratings;
- Creator biographies;
- Social media links;
- Podcast information;
- Show information; and
- Other public-facing content.
Do not publish information that you do not want publicly available.
15. CONTENT MODERATION
We may review, restrict, remove, disable, demonetize, or decline to distribute content when we reasonably believe the content:
- Violates these Terms;
- Violates applicable law;
- Infringes another person’s rights;
- Creates security risks;
- Constitutes fraud;
- Violates advertiser or distribution requirements;
- Contains malware;
- Creates material legal risk; or
- Materially interferes with the operation of the Services.
We are not obligated to monitor every piece of User Content.
Our decision not to remove content does not constitute endorsement of that content.
16. RADIO, PODCAST, AND STREAMING SERVICES
The Culture Radio Network provides access to live and prerecorded media.
Programming may include content owned or operated by:
- The Culture Media;
- DJs;
- Podcasters;
- Creators;
- Artists;
- Broadcasters;
- Distribution partners;
- Licensors; or
- Other third parties.
Programming and station availability may change at any time.
We do not guarantee that any particular station, show, podcast, episode, creator, artist, or program will remain continuously available.
17. MUSIC AND CONTENT SUBMISSIONS
Artists, creators, labels, managers, producers, podcasters, DJs, publicists, and other representatives may submit content for consideration.
Submission does not guarantee:
- Airplay;
- Acceptance;
- Distribution;
- Rotation;
- Playlist placement;
- Promotion;
- Editorial coverage;
- Interviews;
- Sponsorship;
- Compensation; or
- Any business relationship.
You represent that you are authorized to submit materials you provide.
18. FEES
Some Services may be offered without charge while others may require payment.
We may introduce fees for Services that were previously free.
Where payment is required, applicable pricing and payment terms will be disclosed before purchase.
Your previous use of a free Service does not create a permanent right to receive that Service without charge.
19. SUBSCRIPTIONS AND PREMIUM SERVICES
We may offer paid subscriptions or premium Services.
Applicable terms may include:
- Subscription price;
- Billing frequency;
- Renewal terms;
- Trial periods;
- Cancellation requirements;
- Refund policies;
- Included features; and
- Other conditions.
These terms will be disclosed when you subscribe.
Where a subscription automatically renews, renewal information will be disclosed as required by applicable law.
20. PAYMENT AUTHORIZATION
If you purchase a paid Service, you authorize us or our payment processor to charge your selected payment method for applicable amounts.
You represent that:
- You are authorized to use the payment method;
- Payment information you provide is accurate; and
- You will pay applicable charges.
Payments may be processed by third-party payment providers.
21. CANCELLATIONS AND REFUNDS
Cancellation and refund rights may vary by Service.
Applicable cancellation and refund terms will be disclosed when you purchase or subscribe.
Where a subscription is purchased through a third-party platform, such as an app store, cancellation and refund requests may need to be handled through that platform.
Nothing in these Terms limits refund rights required by applicable law.
22. ADVERTISING AND SPONSORSHIPS
The Services may contain:
- Advertisements;
- Sponsorships;
- Branded content;
- Affiliate promotions;
- Host-read advertisements;
- Display advertisements;
- Audio advertisements;
- Video advertisements; and
- Promotional partnerships.
The appearance of an advertisement does not necessarily constitute our endorsement of the advertiser or its products or services.
Advertisers are responsible for claims concerning their products and services.
23. THIRD-PARTY MERCHANTS
The Services may provide access to products or services offered by third parties.
Unless expressly stated otherwise, transactions with independent third-party merchants are between you and the merchant.
The third-party merchant may be responsible for:
- Payment processing;
- Product quality;
- Shipping;
- Delivery;
- Returns;
- Refunds;
- Warranties; and
- Customer service.
Your transaction may be subject to the merchant’s own terms and policies.
24. THIRD-PARTY LINKS AND SERVICES
The Services may link to or integrate with third-party websites, applications, streaming platforms, social networks, payment providers, advertisers, and other services.
We do not control independent third-party services.
A link or integration does not necessarily constitute our endorsement.
Your use of third-party services is subject to their applicable terms and privacy policies.
25. EVENTS
The Culture Media or The Culture Radio Network may organize, promote, sponsor, cover, or participate in events.
Specific events may be subject to additional:
- Ticket terms;
- Venue rules;
- Safety requirements;
- Age restrictions;
- Recording policies;
- Release forms; or
- Participation agreements.
Attendance at an event involves ordinary risks associated with live events and public gatherings.
You agree to comply with applicable venue rules and reasonable safety instructions.
26. EVENT PHOTOGRAPHY AND RECORDING
At Culture Media-sponsored events, photography, audio recording, livestreaming, and video recording may occur.
Where permitted by applicable law, attendees may appear incidentally in photographs, audio recordings, livestreams, or video footage documenting or promoting an event.
Separate releases may be required for featured appearances, performances, interviews, minors, or uses requiring additional consent under applicable law.
27. CONTESTS, SWEEPSTAKES, AND PROMOTIONS
We may offer contests, sweepstakes, giveaways, games, or other promotions.
Each promotion may have official rules covering matters such as:
- Eligibility;
- Entry periods;
- Geographic restrictions;
- Age requirements;
- Prize descriptions;
- Winner selection;
- Taxes; and
- Claim requirements.
If promotion-specific rules conflict with these Terms, the promotion-specific rules control concerning that promotion.
28. VOTING AND RATINGS
Certain Services may permit voting, ratings, rankings, or similar participation.
You may not:
- Use automated voting systems;
- Submit votes beyond stated limits;
- Purchase votes;
- Sell votes;
- Manipulate voting results;
- Use scripts or bots to vote; or
- Otherwise interfere with the integrity of a voting or rating system.
We may invalidate votes or ratings that we reasonably determine violate applicable rules.
29. REFERRAL PROGRAMS
We may offer referral programs.
If you provide another person’s contact information through an authorized referral feature, you represent that you have permission to provide that information where required by applicable law.
Referral programs may have Additional Terms covering eligibility, rewards, limitations, and other conditions.
We may modify or discontinue referral programs at any time.
30. SOFTWARE AND DOWNLOADS
Software, mobile applications, players, tools, and other technology made available through the Services may be owned by The Culture Media or licensed from third parties.
Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to use such software for its intended purpose.
You may not:
- Copy protected software;
- Sell it;
- Sublicense it;
- Circumvent technical restrictions;
- Reverse engineer it except where permitted by law; or
- Use it to create an unauthorized competing service.
Additional software-license terms may apply.
31. INTELLECTUAL PROPERTY
The Culture Radio Network Services contain intellectual property owned by or licensed to The Culture Media, Society Capital, their affiliates, or third parties.
Protected materials may include:
- Names;
- Logos;
- Trademarks;
- Graphics;
- Artwork;
- Photographs;
- Articles;
- Videos;
- Audio;
- Programming;
- Software;
- Databases;
- Website designs;
- Application designs;
- Station branding; and
- Show branding.
Except as expressly permitted, you may not reproduce, distribute, modify, sell, publicly display, publicly perform, license, or commercially exploit protected materials without authorization.
32. TRADEMARKS
The Culture Radio Network, The Culture Media, associated logos, station names, program names, and related brand identifiers may be trademarks or service marks belonging to The Culture Media, Society Capital, their affiliates, or licensors.
Nothing in these Terms grants you a license to use our trademarks for commercial purposes without written authorization.
33. COPYRIGHT INFRINGEMENT AND DMCA
The Culture Media respects intellectual property rights.
If you believe content appearing through The Culture Radio Network infringes your copyright, you may submit a copyright notice.
A valid notice should include information required by applicable law, including:
- Identification of the copyrighted work;
- Identification of the allegedly infringing material;
- Information reasonably sufficient for us to locate the material;
- Your contact information;
- A good-faith statement that the disputed use is unauthorized;
- A statement concerning the accuracy of the notice and your authority to act; and
- Your physical or electronic signature.

34. ARTIFICIAL INTELLIGENCE, DATA MINING, AND AUTOMATED EXTRACTION
Except where expressly authorized by The Culture Media in writing or permitted by applicable law, you may not use The Culture Radio Network proprietary content, data, software, metadata, databases, or other protected materials to:
- Train artificial intelligence models;
- Train machine-learning models;
- Create unauthorized datasets;
- Scrape or harvest protected content;
- Create unauthorized digital replicas of personalities, hosts, creators, or performers;
- Clone voices from protected recordings;
- Generate unauthorized simulations using our proprietary content;
- Develop competing content databases from our Services;
- Extract source code or proprietary algorithms;
- Circumvent technical protections; or
- Use automated systems to systematically copy substantial portions of our Services.
This section does not restrict lawful uses that cannot legally be prohibited.
35. AI-GENERATED FEATURES
The Culture Radio Network may use or offer features incorporating artificial intelligence, machine learning, automation, recommendation systems, or similar technologies.
AI-generated or automated outputs may contain errors or inaccuracies.
You should independently evaluate information before relying upon it for important decisions.
Unless expressly stated otherwise, AI-generated content is provided for informational or entertainment purposes and does not constitute legal, financial, medical, or other professional advice.
36. INTERNATIONAL USE
The Culture Radio Network is operated from the United States.
We do not represent that every Service or piece of content is appropriate or legally available in every country.
If you access the Services from outside the United States, you are responsible for compliance with applicable local law.
37. U.S. EXPORT CONTROLS AND SANCTIONS
You may not use, export, re-export, transfer, or provide the Services in violation of applicable United States export-control or economic-sanctions laws.
You represent that you are not prohibited from receiving the Services under applicable United States law.
38. SERVICE AVAILABILITY
We work to keep the Services operational but do not guarantee uninterrupted availability.
Services may be affected by:
- Maintenance;
- Updates;
- Server problems;
- Internet outages;
- Streaming-provider outages;
- Equipment failures;
- Cybersecurity incidents;
- Power failures;
- Third-party failures;
- Natural disasters; or
- Other circumstances.
We may modify, suspend, or discontinue a Service or feature.
39. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
The Culture Media, Society Capital, their affiliates, licensors, and service providers do not guarantee that:
- The Services will always be available;
- The Services will be uninterrupted;
- The Services will be error-free;
- Every defect will be corrected;
- All information will be accurate;
- All content will remain available;
- Every device will be compatible; or
- The Services will meet every user’s expectations.
To the maximum extent permitted by law, we disclaim implied warranties including merchantability, fitness for a particular purpose, title, and non-infringement.
Nothing in these Terms excludes rights or warranties that cannot legally be excluded.
40. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, The Culture Media, Society Capital, their affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to your use of or inability to use the Services.
This may include:
- Lost profits;
- Lost revenue;
- Lost data;
- Lost business opportunities;
- Business interruption;
- Loss of goodwill; or
- Other intangible losses.
To the maximum extent permitted by applicable law, our aggregate liability relating to the Services will not exceed the greater of:
- The amount you paid directly to The Culture Media for the applicable Service during the twelve months preceding the event giving rise to the claim; or
- One hundred U.S. dollars ($100).
Where applicable law prohibits a particular limitation, that limitation applies only to the maximum extent permitted by law.
41. INDEMNIFICATION
To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Culture Media, Society Capital, their affiliates, and their respective officers, directors, employees, contractors, and agents from claims, liabilities, losses, damages, costs, and reasonable attorneys’ fees arising from:
- Your violation of these Terms;
- Your User Content;
- Your violation of applicable law;
- Your infringement of another person’s rights; or
- Your misuse of the Services.
We may assume control of the defense of a matter subject to indemnification, in which case you agree to reasonably cooperate.
42. SUSPENSION AND TERMINATION
We may suspend, restrict, or terminate access to the Services when reasonably necessary because of:
- Violation of these Terms;
- Fraud;
- Security concerns;
- Intellectual property violations;
- Illegal activity;
- Nonpayment;
- Abuse of the Services;
- Material harm to another user;
- Legal requirements; or
- Discontinuation of a Service.
You may stop using the Services at any time.
Provisions that by their nature should survive termination will continue to apply.
43. INFORMAL DISPUTE RESOLUTION
Before initiating formal legal proceedings, you and The Culture Media agree to make a reasonable good-faith effort to resolve disputes informally.
A dispute notice should identify:
- Your name;
- Contact information;
- The nature of the dispute;
- Relevant facts; and
- The requested resolution.

The parties will have at least 30 days after receipt of the notice to attempt informal resolution before initiating arbitration, except where immediate injunctive relief is reasonably necessary.
44. BINDING ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for eligible small claims matters and certain claims seeking temporary or preliminary injunctive relief, disputes arising from or relating to these Terms or the Services will be resolved through binding individual arbitration rather than a jury trial.
The Federal Arbitration Act governs this arbitration provision.
Unless the parties agree otherwise, arbitration will be administered by the American Arbitration Association (AAA) under applicable AAA rules.
The arbitrator may award relief available to an individual party under applicable law.
45. CLASS ACTION WAIVER
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND THE CULTURE MEDIA AGREE TO BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR MEMBER OF A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.
If any portion of this provision is determined to be unenforceable, it will be severed to the extent necessary while the remaining provisions continue to apply.
46. GOVERNING LAW AND VENUE
These Terms will be governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
For disputes not subject to arbitration, the parties consent to the jurisdiction of the appropriate state or federal courts located in or serving Orange County, Florida, to the extent permitted by law.
47. FORCE MAJEURE
We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including:
- Natural disasters;
- Severe weather;
- Fire;
- War;
- Terrorism;
- Civil disturbances;
- Government actions;
- Labor disruptions;
- Power outages;
- Internet failures;
- Cyberattacks;
- Telecommunications failures;
- Streaming-provider failures;
- Cloud-service outages; or
- Other events outside our reasonable control.
48. SEVERABILITY
If a provision of these Terms is determined to be invalid or unenforceable, it will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will remain in effect.
49. NO WAIVER
Our failure to enforce a provision does not waive our right to enforce that provision later.
A waiver must be expressly authorized to be effective.
50. ASSIGNMENT
You may not assign your rights or obligations under these Terms without our written consent.
The Culture Media may assign these Terms in connection with a merger, acquisition, corporate restructuring, financing, sale of assets, transfer among affiliated companies, or similar transaction, subject to applicable law.
51. NO EMPLOYMENT, PARTNERSHIP, OR AGENCY
Use of The Culture Radio Network does not automatically create an employment, partnership, joint venture, franchise, agency, fiduciary, management, or similar relationship between you and:
- The Culture Radio Network;
- The Culture Media;
- Society Capital; or
- Their affiliates.
Creators, DJs, podcasters, artists, advertisers, sponsors, and other participants remain independent parties unless a separate written agreement expressly provides otherwise.
52. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy and any applicable Additional Terms, policies, official contest rules, subscription terms, creator agreements, advertising agreements, or other incorporated documents, constitute the applicable agreement governing your use of the Services.
A separate written agreement with The Culture Media may supplement these Terms.
Where a valid separate agreement expressly conflicts with these Terms regarding its subject matter, the separate agreement will control for that subject matter.
53. CORPORATE RELATIONSHIP
For clarity:
Society Capital, Inc.
is the umbrella company for its affiliated portfolio of companies, businesses, and brands.
The Culture Media, LLC.
is the media parent company within the Society Capital corporate family.
The Culture Radio Network
