PODCAST SUBMISSION & DISTRIBUTION TERMS

These Podcast Submission & Distribution Terms (“Podcast Terms”) govern the submission, listing, importation, display, playback, promotion, distribution, and management of podcasts through The Culture Radio, a platform operated by The Culture Media, part of the Society Capital Group family of companies.
These Podcast Terms apply to podcast creators, hosts, producers, publishers, podcast networks, distributors, representatives, rights holders, and other individuals or organizations that submit, claim, manage, or authorize podcasts for inclusion on The Culture Radio.
These Terms should be read together with our Creator Terms & Content Submission Agreement, Community Guidelines, Copyright & DMCA Policy, Privacy Policy, and other applicable Platform policies.
By submitting, claiming, or managing a podcast through The Culture Radio, you acknowledge that you have read, understood, and agreed to these Podcast Terms.
If you act on behalf of another person, podcast, network, business, or organization, you represent that you have authority to accept these Terms on its behalf.
1. THE CULTURE RADIO PODCAST PLATFORM
The Culture Radio provides podcast discovery, listening, promotion, creator, and related media services.
Podcast features may include:
- Podcast directory listings;
- Podcast search;
- Podcast categories;
- Episode listings;
- Podcast playback;
- Creator Profiles;
- Featured podcasts;
- Trending podcasts;
- New podcast discovery;
- Podcast recommendations;
- Podcast artwork;
- Episode descriptions;
- Creator information;
- Links to external podcast platforms;
- RSS feed integration;
- Podcast analytics;
- Promotional opportunities; and
- Other podcast-related services.
Features may change as the Platform develops.
2. WAYS PODCASTS MAY APPEAR ON THE PLATFORM
Podcasts may appear on The Culture Radio through several methods.
These may include:
- Direct Creator submissions;
- RSS feed submissions;
- Podcast claiming;
- Podcast network submissions;
- Authorized distribution feeds;
- Podcast APIs;
- Publicly accessible RSS feeds;
- Syndication services;
- Podcast databases;
- Content partnerships; or
- Other lawful sources.
The method by which a podcast appears on The Culture Radio may affect the features available to the podcast owner.
3. DIRECTORY LISTING VS. HOSTING
Unless expressly stated otherwise, listing a podcast on The Culture Radio does not mean that The Culture Radio hosts the podcast’s original audio files.
For many podcasts, The Culture Radio may obtain podcast information through an RSS feed and provide access to audio hosted by the Creator’s existing podcast hosting provider.
In those situations:
The Culture Radio acts as a discovery and listening platform and does not become the original host of the podcast solely because the podcast appears on our Platform.
If The Culture Radio later offers direct podcast hosting, separate terms may apply to those services.
4. PODCAST OWNERSHIP
Podcast creators and applicable rights holders retain ownership of the intellectual property they legally own.
Submitting or listing a podcast does not transfer ownership to:
- The Culture Radio;
- The Culture Media; or
- Society Capital Group.
The Culture Radio does not claim ownership of a third-party podcast merely because it appears in our directory, search results, application, website, or other Platform feature.
5. LICENSE FOR SUBMITTED PODCASTS
If you directly submit, claim, or authorize a podcast for inclusion on The Culture Radio, you grant The Culture Media and The Culture Radio a non-exclusive, worldwide, royalty-free license, with respect to rights you control, to use the podcast materials reasonably necessary to provide and promote the Platform.
This may include the right to:
- Display the podcast title;
- Display podcast artwork;
- Display episode artwork;
- Display episode titles;
- Display episode descriptions;
- Display show descriptions;
- Display host and Creator information;
- Display submitted photographs;
- Display categories;
- Display publication dates;
- Display metadata;
- Retrieve information from the submitted RSS feed;
- Provide playback of episodes through authorized feeds;
- Create technically necessary cached copies;
- Format information for different devices;
- Include the podcast in search results;
- Include the podcast in categories;
- Include the podcast in recommendation systems;
- Feature the podcast;
- Promote the podcast;
- Create links to podcast pages;
- Display Creator Profiles connected to the podcast; and
- Use reasonable excerpts, artwork, names, and descriptions to promote the podcast’s availability through The Culture Radio.
This license does not transfer ownership of your podcast to us.
6. RSS FEED AUTHORIZATION
When you submit an RSS feed to The Culture Radio, you authorize us to periodically access that feed for purposes of maintaining your podcast listing and related Platform functionality.
Information retrieved may include:
- Podcast title;
- Podcast description;
- Podcast artwork;
- Episode titles;
- Episode descriptions;
- Audio URLs;
- Episode artwork;
- Publication dates;
- Episode duration;
- Explicit-content information;
- Categories;
- Author information;
- Website information;
- Copyright notices;
- Episode numbers;
- Season numbers; and
- Other information contained within the feed.
We may periodically refresh this information as the RSS feed changes.
7. AUTOMATIC EPISODE UPDATES
Where supported, new episodes published through a connected RSS feed may automatically appear on The Culture Radio.
Creators do not necessarily need to manually submit each new episode.
The timing of updates may depend on:
- RSS feed availability;
- Platform refresh schedules;
- Podcast hosting services;
- Technical processing;
- Caching; and
- Other systems outside our control.
We do not guarantee immediate publication of an episode after it appears in the original RSS feed.
8. PUBLICLY AVAILABLE PODCAST INFORMATION
The Culture Radio may display certain publicly available information about podcasts obtained through lawful sources.
This may include:
- Podcast name;
- Artwork;
- Description;
- Publisher;
- Categories;
- Episode information;
- Public RSS information;
- Public website links; and
- Other information used for podcast discovery.
If you are the owner or authorized representative of a podcast and believe information displayed on The Culture Radio is incorrect or should be removed, you may contact us using the procedures below.
9. CLAIMING A PODCAST
The Culture Radio may allow Creators to claim podcast listings.
Claiming a podcast may provide access to additional features, which could include:
- Editing Creator information;
- Connecting a Creator Profile;
- Updating promotional information;
- Accessing analytics;
- Managing links;
- Submitting featured Content;
- Updating artwork;
- Adding social media information; and
- Other Creator tools.
Available features may change over time.
10. PODCAST OWNERSHIP VERIFICATION
Before allowing someone to control a podcast listing, we may require verification.
Verification methods may include:
- Email verification;
- Verification through an RSS feed;
- Verification through the podcast website;
- Verification through a hosting provider;
- Documentation;
- Confirmation from the podcast publisher; or
- Other reasonable methods.
We may refuse or revoke a claim if we cannot reasonably verify the person’s authority.
11. CREATOR PROFILES
Podcast hosts and Creators may be connected to Creator Profiles on The Culture Radio.
Creator Profiles may display:
- Name;
- Stage or professional name;
- Photograph;
- Biography;
- Location;
- Website;
- Social media links;
- Podcasts;
- Radio shows;
- Stations;
- Featured Content; and
- Other professional information.
The Creator remains responsible for the accuracy of information they directly submit.
12. YOUR RESPONSIBILITY FOR PODCAST CONTENT
Creators remain responsible for the podcasts they submit or control.
By submitting or claiming a podcast, you represent that you have sufficient authority regarding the Content and materials you provide.
This includes, where applicable:
- Audio;
- Music;
- Artwork;
- Photographs;
- Video;
- Interviews;
- Guest appearances;
- Written material;
- Trademarks;
- Logos;
- Sound effects;
- Clips;
- Samples; and
- Other copyrighted material.
13. MUSIC USED IN PODCASTS
Podcast Creators are responsible for ensuring they have appropriate rights to music incorporated into their podcast episodes.
The fact that The Culture Radio may separately maintain licenses for certain radio programming does not automatically provide a podcast Creator with permission to incorporate copyrighted music into an independently produced podcast.
Creators should obtain any licenses, permissions, or other authorization required for music included in their podcasts.
14. GUESTS AND INTERVIEWS
Creators are responsible for obtaining permissions or releases that may be required for guests, interviews, performances, or other third-party contributions.
The Culture Radio is not responsible for disputes between a podcast Creator and a guest, co-host, producer, employee, contractor, or other participant.
15. PODCAST ARTWORK
By submitting podcast artwork, you represent that you own the artwork or have authorization to use it.
You authorize The Culture Radio to display and resize submitted artwork as reasonably necessary for:
- Podcast pages;
- Search results;
- Homepage sections;
- Categories;
- Creator Profiles;
- Mobile applications;
- Recommendations;
- Promotional graphics; and
- Social media promotion.
16. PODCAST METADATA
Creators should provide accurate podcast metadata.
Metadata may include:
- Podcast title;
- Creator or publisher;
- Description;
- Categories;
- Language;
- Explicit-content designation;
- Episode titles;
- Season numbers;
- Episode numbers;
- Publication dates;
- Copyright information; and
- Contact information.
We may correct formatting or obvious technical issues without changing the fundamental meaning of the information.
17. EXPLICIT CONTENT
Creators should accurately identify podcasts and episodes containing explicit material where applicable.
The Culture Radio may:
- Display an explicit-content label;
- Restrict certain Content;
- Limit promotion;
- Restrict availability to certain audiences; or
- Take other reasonable measures.
Explicit language or mature discussion does not automatically violate our Community Guidelines.
18. EDITORIAL DISCRETION
The Culture Radio retains editorial discretion concerning podcast discovery and promotion.
We may determine:
- Which podcasts are featured;
- Which podcasts appear on the homepage;
- Category placement;
- Trending placement;
- Recommendation placement;
- Search presentation;
- Promotional placement;
- Creator features; and
- Other editorial presentation.
Submission does not guarantee featured placement.
19. TRENDING AND POPULAR PODCASTS
The Culture Radio may identify podcasts as trending, popular, featured, recommended, new, or otherwise noteworthy.
These designations may be based on factors including:
- Listening activity;
- Episode activity;
- User engagement;
- Clicks;
- Recency;
- Editorial selection;
- Audience interest;
- Platform activity; and
- Other signals.
We may change ranking methodologies at any time.
20. ARTIFICIAL PODCAST ACTIVITY
Creators may not manipulate Platform metrics through fraudulent means.
Prohibited behavior includes:
- Fake listens;
- Automated episode plays;
- Bots;
- Click farms;
- Fake accounts;
- Artificial downloads;
- Automated engagement;
- Fraudulent traffic; or
- Attempts to manipulate rankings.
We may remove suspected fraudulent activity from Platform analytics and rankings.
21. PODCAST ANALYTICS
The Culture Radio may provide Creators with analytics concerning podcast activity.
Analytics may include:
- Plays;
- Clicks;
- Page views;
- Listener activity;
- Popular episodes;
- Device information;
- General geographic information;
- Referral information;
- Engagement; and
- Other performance measurements.
Analytics may contain estimates, delayed reporting, filtering, or discrepancies.
We do not guarantee that Platform analytics will exactly match analytics from a Creator’s podcast hosting provider.
22. EXTERNAL PODCAST PLATFORMS
The Culture Radio may provide links to third-party podcast services.
These could include services through which users may listen to, follow, or subscribe to podcasts.
The Culture Radio does not control independent third-party platforms.
Availability on The Culture Radio does not guarantee availability on any other podcast service.
23. DISTRIBUTION SERVICES
If The Culture Radio offers a service that directly distributes a Creator’s podcast to third-party platforms, additional terms may apply.
Those terms may address:
- Distribution destinations;
- Feed ownership;
- Hosting;
- Analytics;
- Advertising;
- Monetization;
- Revenue sharing;
- Migration;
- Account ownership; and
- Termination.
Unless expressly agreed in writing, a normal listing on The Culture Radio does not authorize us to transfer ownership or administrative control of your podcast to another platform.
24. PODCAST MONETIZATION
The Culture Radio may offer podcast monetization opportunities.
These may include:
- Advertising;
- Sponsorships;
- Branded Content;
- Affiliate campaigns;
- Creator partnerships;
- Paid subscriptions; or
- Other programs.
Participation may require a separate agreement.
The appearance of a podcast on The Culture Radio does not automatically entitle the Creator to advertising, subscription, sponsorship, or other Platform revenue.
25. ADVERTISING WITHIN PODCASTS
A Creator’s original podcast feed may contain advertising inserted by the Creator, network, host, or advertising provider.
The Culture Radio is not automatically a party to those independent advertising arrangements.
If The Culture Media separately sells advertising associated with a podcast, the applicable agreement will determine responsibilities, compensation, and revenue sharing.
26. NO GUARANTEE OF REVENUE
The Culture Radio does not guarantee that a podcast listing will result in:
- Advertising revenue;
- Sponsorship revenue;
- Increased downloads;
- Increased listeners;
- Subscriber growth;
- Business opportunities;
- Creator partnerships;
- Media coverage; or
- Commercial success.
27. PODCAST REMOVAL REQUESTS
A verified podcast owner or authorized representative may request removal of a podcast from The Culture Radio.
Requests should be sent to:

- Podcast name;
- Podcast URL on The Culture Radio;
- RSS feed URL, if available;
- Your name;
- Your relationship to the podcast;
- Your email address; and
- A statement requesting removal.
We may require reasonable verification before processing the request.
28. EFFECT OF PODCAST REMOVAL
After a verified removal request is processed, we may discontinue active display or retrieval of the podcast within a commercially reasonable period.
Certain information may temporarily remain in:
- Caches;
- Backups;
- Search indexes;
- Analytics;
- Security records;
- Legal records; or
- Other systems where temporary retention is reasonably necessary.
We may retain information where required or permitted by law.
29. RSS FEED REMOVAL OR CHANGES
If a podcast RSS feed becomes unavailable, changes location, or stops functioning, episodes may stop updating or playing correctly.
Creators should notify us when significant feed changes occur if the Platform does not automatically detect them.
30. COPYRIGHT COMPLAINTS
The Culture Radio respects intellectual property rights.
If you believe a podcast or other material available through the Platform infringes your copyright, please follow our Copyright & DMCA Policy.

31. CONTENT REMOVAL
The Culture Radio may remove or restrict a podcast or episode when we reasonably believe:
- It violates applicable law;
- It violates our Community Guidelines;
- It violates these Podcast Terms;
- It infringes intellectual property rights;
- We receive a valid legal request;
- The RSS feed becomes invalid;
- The Creator requests removal;
- The Content creates significant security concerns; or
- Continued availability creates a material legal or Platform risk.
32. DISPUTES BETWEEN PODCAST OWNERS
The Culture Radio is not responsible for resolving private ownership disputes between:
- Hosts;
- Co-hosts;
- Podcast networks;
- Producers;
- Businesses;
- Former partners;
- Employees;
- Contractors;
- Publishers; or
- Other parties.
If a legitimate ownership dispute occurs, we may temporarily restrict administrative control or remove disputed Content while the parties resolve the matter.
33. PLATFORM AVAILABILITY
We do not guarantee uninterrupted podcast availability.
Temporary interruptions may occur because of:
- Maintenance;
- Server problems;
- RSS feed errors;
- Hosting-provider outages;
- Internet outages;
- Software updates;
- Security incidents;
- Third-party failures; or
- Other technical circumstances.
34. NO EXCLUSIVITY
Unless a separate written agreement states otherwise, listing or submitting a podcast to The Culture Radio is non-exclusive.
Creators remain free to distribute their podcasts through other websites, applications, directories, networks, and platforms.
35. NO EMPLOYMENT OR PARTNERSHIP
Submitting or listing a podcast does not create an:
- Employment relationship;
- Partnership;
- Joint venture;
- Agency relationship;
- Management relationship; or
- Ownership relationship.
A separate written agreement is required to establish such a relationship.
36. INDEMNIFICATION
To the extent permitted by applicable law, Creators who directly submit, claim, or manage podcasts agree to indemnify, defend, and hold harmless The Culture Media, The Culture Radio, Society Capital Group, and their applicable affiliates, officers, directors, employees, representatives, and agents from third-party claims, liabilities, damages, losses, and reasonable costs arising from:
- Content directly submitted by the Creator;
- A material breach of these Podcast Terms;
- The Creator’s violation of applicable law;
- The Creator’s infringement of third-party rights; or
- A material misrepresentation concerning the Creator’s authority to submit or manage the podcast.
37. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, The Culture Media, The Culture Radio, Society Capital Group, and their applicable affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from podcast listing, submission, discovery, or Platform availability.
Nothing in these Terms limits liability that cannot legally be limited.
38. CHANGES TO PODCAST SERVICES
The Culture Radio may introduce, modify, replace, or discontinue podcast features.
This may include changes to:
- Podcast directories;
- Search;
- Categories;
- Creator Profiles;
- Analytics;
- Recommendations;
- Import systems;
- RSS processing;
- Monetization;
- Advertising;
- Distribution; and
- Other podcast services.
39. CHANGES TO THESE TERMS
We may update these Podcast Terms periodically.
The “Last Updated” date at the top identifies the most recent revision.
Material changes may be communicated through the Platform where required by applicable law.
40. GOVERNING LAW
To the extent permitted by applicable law, these Podcast Terms will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.
41. SEVERABILITY
If any provision of these Podcast Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

PODCAST SUBMISSION ACKNOWLEDGMENT
Before directly submitting or claiming a podcast, the Creator should be required to confirm:
By submitting or claiming this podcast, I confirm that I own, control, or am authorized to represent the podcast. I authorize The Culture Radio and The Culture Media to retrieve applicable podcast information from the submitted RSS feed and to display, provide playback access to, categorize, and promote the podcast in accordance with the Podcast Submission & Distribution Terms. I understand that I retain ownership of my podcast and that submission does not guarantee promotion, audience growth, monetization, or compensation.
- I have read and agree to the Podcast Submission & Distribution Terms.
- I confirm that I own, control, or am authorized to represent this podcast.
- I authorize The Culture Radio to retrieve and update podcast information from the submitted RSS feed.
- I understand that listing my podcast does not guarantee promotion, monetization, or compensation.
